Dog Bites
Dog bites present serious medical, legal and investigative issues which require immediate attention.
Medical Issues
According to the New England Journal of Medicine dog bites should always receive immediate medical attention. A dogs mouth contains a complex mix of microbiologic material with a high risk of infection. Because of this any bite that breaks the skin should be treated by a doctor on the date of the attack. One gentleman I represented paid dearly for not getting checked out. Thinking his mild puncture wounds would not present problems he did not go to the doctor. He used a first aid kit.Soon a super infection was raging that caused him bto completely lose four of the bones in his hand. First, get to your doctor or an emergency room on the date of the attack as soon as possible.
Legal Issues
A dog bite victims rights vary depending upon whether the attack occurred in a municipality or in a part of a Texas County that has no incorporated citites or towns. Second, it is important to look at whether the dog was on its own property or had wandered off into a another persons yard or street.
Dog bites can be covered under the dog owner’s homeowners insurance. Law enforcement officers typically don’t look at this insurance issue. You should consult an experienced personal injury attorney to preserve you right to be fairly compensated. Homeowners insurance companies will not come and look up the injured person and try to help them. They hope that the victim will not figure the situation out and will fail to make a claim.
Investigation
One of the things we do very well is investigate claims. Our director of investigations, Cliff Carpenter Jr., is a former agent for the Federal Bureau of Alcohol, Tobacco and Firearms. Within 24 hours of being hired in any type of case we will have an investigator on the scene of the accident taking photographs of the scene and the dog involved. Witnesses to the attack will be interviewed and the neighborhood will be canvassed to see what level of problem the dog might have presented in the past.
This comprehensive approach gives out office the ammunition it needs to put any insurance company on notice that we are taking a serious problem seriously.Because of the extra effort we put in we are often able to resolve cases without filing suit saving our client a lot of expense and delay.
